Terms of Service

These Terms of Service ("Terms") govern your access to and use of ResaleRadar AI (the "Service"), a website and email-alert service operated by Housecraft LLC ("Housecraft", "we", "us", or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ResaleRadar AI scans publicly listed estate sale photographs near a location you choose and sends you email alerts when new photos appear to match the items you tell us you are looking for. Matches are generated by automated image analysis and are provided for your convenience only. We do not run, host, or take part in any estate sale, and we do not guarantee the availability, condition, price, authenticity, or existence of any item shown in a photo or alert.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for keeping your password confidential. You are responsible for all activity that occurs under your account.

3. Subscriptions, Billing, and Cancellation

Paid plans are billed in advance on a recurring monthly basis at the price shown at checkout (currently $10.00 USD per month for the paid plan, plus any applicable taxes). Payments are processed by Stripe, Inc.; by subscribing you also agree to Stripe's terms. Your subscription renews automatically each month until you cancel.

You may cancel at any time, and cancellation stops future billing at the end of your current billing period. Fees already paid for the current billing period are non-refundable, and partial-month periods are not prorated, except where a refund is required by applicable law. We may change subscription prices on a going-forward basis; we will give you notice before a price change takes effect, and the new price will apply to your next renewal.

4. Acceptable Use

You agree not to misuse the Service, including by: attempting to gain unauthorized access to the Service or its systems; scraping, reselling, or redistributing alerts or data without permission; interfering with the operation of the Service; or using the Service for any unlawful purpose.

5. Intellectual Property

The Service, including its software, design, and branding, is owned by Housecraft LLC and protected by applicable law. Estate sale photographs surfaced through the Service remain the property of their respective owners; we make no claim to them and present them only to help you identify potential matches.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that alerts will be accurate, complete, timely, or uninterrupted.

7. Limitation of Liability

To the fullest extent permitted by law, Housecraft LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

9. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email. Your continued use of the Service after changes take effect constitutes acceptance.
